The sales-oriented Legal Guide to Uniform Instruments in the Field of International Commercial Contracts, which was prepared in collaboration with the Hague Conference on Private International Law and UNIDROIT, is now available here. The Legal Guide is a user-friendly resource for those wishing to adopt, apply and interpret uniform contract law and provides an overview of the main legal texts produced by the three sister organizations. In particular, it contains the United Nations Convention on Contracts for the International Sale of Goods (CISG), the HCCH Principles on Choice of Law in International Trade Treaties and the UNIDROIT Principles for International Trade Treaties, which illustrate how these texts work together to achieve a predictable but flexible legal framework for international trade. You are also invited to watch a video of the leaders of the three organizations celebrating the launch of this wonderful resource. The CISG has been adopted by 94 States of all legal traditions and stages of economic development, which together account for more than two thirds of the world economy. The UNCITRAL Secretariat is organizing a series of awareness-raising events and technical assistance activities to celebrate the 40th anniversary of the CISG in 2020 (“CISG@40″). The activities CISG@40 pursue several objectives. One of them is to identify potential new States parties to the United Nations Convention on Contracts for the International Sale of Goods, to support and promote the process of acceptance of treaties, namely to accelerate the achievement of the symbolic number of 100 Contracting States and to broaden the scope of the United Nations Convention on Contracts for the International Sale of Goods by supporting the withdrawal of declarations and the extension of territorial for existing Contracting States. Secondly, with regard to its application in practice, the challenge is to raise awareness of the benefits of the CISG in the business environment and in the judicial system for its uniform interpretation. An important part of this activity is the expansion and deepening of the engagement of contributors to THE RIGHT TO UNCITRAL texts (“CLOUT”) and the inclusion of new partners in the CLOUT network.
In this context, the publication in 2020 of a guide to international trade agreements (focused on sales) (prepared jointly by UNCITRAL, the International Institute for the Unification of Private Law (Unidroit) and the Hague Conference on Private International Law) stands out. Other topics relevant to CISG@40 include the use of the United Nations Convention on Contracts for the International Sale of Goods as a model for national legal reform, the wider adoption and use of closely related treaties such as the Restrictions Convention and the Electronic Communications Convention, and issues related to the use of the United Nations Convention on Contracts for the International Sale of goods in the digital economy, such as the relationship between the United Nations Convention on Contracts for the International Sale of Goods and smart contracts. UNCITRAL has prepared other texts in the area of international sales of goods and related transactions. Of particular importance are the Convention on the Limitation Period in the International Sale of Goods (New York, 1974) and the United Nations Convention on the Use of Electronic Communications in International Contracts (New York, 2005).
